1. ACCEPTANCE OF TERMS

By accessing or using WhichAI's services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.

2. DESCRIPTION OF SERVICE

WhichAI provides AI workflow optimization recommendations and tool discovery services. We analyze user tasks and recommend specialized AI tools and workflows to improve productivity.

3. USER ACCOUNTS

• You must provide accurate, complete information when creating an account
• You are responsible for safeguarding your account credentials
• You must immediately notify us of any unauthorized access
• One person or legal entity may not maintain multiple accounts

4. ACCEPTABLE USE

You may not use our service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Generate harmful, illegal, or malicious content
• Reverse engineer or attempt to extract our algorithms
• Use our service for competitive intelligence against us

5. INTELLECTUAL PROPERTY

• WhichAI retains all rights to our platform, algorithms, and recommendations
• You retain rights to your input data and generated workflows
• You grant us a limited license to process your data to provide services
• Our tool recommendations and workflow suggestions are proprietary

6. PAYMENT TERMS

• Subscription fees are billed in advance monthly or annually
• All fees are non-refundable except as expressly stated
• We may change pricing with 30 days notice
• Failure to pay may result in service suspension

7. DATA AND PRIVACY

• We collect and process data as described in our Privacy Policy
• We do not sell your personal data to third parties
• We use industry-standard security measures
• You can request data deletion at any time

8. SERVICE AVAILABILITY

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects availability
• We are not liable for third-party service interruptions

9. LIMITATION OF LIABILITY

IN NO EVENT SHALL WHICHAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. INDEMNIFICATION

You agree to indemnify and hold WhichAI harmless from any claims, damages, or expenses arising from your use of the service or violation of these terms.

11. TERMINATION

• Either party may terminate at any time
• We may suspend or terminate accounts for Terms violations
• Upon termination, your right to use the service ceases immediately
• Survival clauses: Sections 6, 9, 10, 11, and 12 survive termination

12. GOVERNING LAW

These Terms are governed by Wyoming state law and federal US law. Any disputes will be resolved in Wyoming courts or through binding arbitration.

13. CHANGES TO TERMS

We may modify these Terms at any time. Material changes will be notified via email or service notification.
